Abstract

Illegal fees are a form of extraordinary crime (extra ordinary crime) because illegal fees are included in the criminal act of corruption. The government's determination to eradicate extortion has become increasingly evident with the issuance of Law no. 31 of 1999 concerning the eradication of corruption, Law No. 28 of 1999 concerning the administration of a country that is clean and free from collusion, corruption and nepotism and Presidential Regulation No. 87 of 2016 concerning a task force to clean up illegal levies. Problems arise in the investigation of illegal levies carried out by the Klaten Resor Police, which causes the investigation of illegal levies in the Klaten Regency jurisdiction to be obstructed. The aim of the writer in this study is to find out the steps taken by the Klaten Police in investigating illegal extortion cases as a criminal act of corruption in the Klaten Police jurisdiction, analyzing the legal arrangements applied in investigating cases of extortion as a criminal act of corruption in the area. Klaten Polres law and as a study of the factors that hinder the investigation of cases of extortion as a criminal act of corruption in the jurisdiction of the Klaten Police. The research method used in this research is empirical or sociological. The research results in the conclusion of the results of this study, the obstruction of the legal process of illegal levies in the jurisdiction of the Klaten Resor Police is an obstacle in the evidentiary process because they are suspected of returning illegal fees so that criminal acts do not occur (so that it seems that illegal levies never occur), people are reluctant to summoned as a witness, differences in perceptions between prosecutors and investigators regarding the articles that must be applied, and unclear legal rules regarding the element of coercion in the criminal act of extortion.
