Abstract

This study aims to determine criminal liability for exhibitionism perpetrators according to Indonesian criminal law. This study uses a normative juridical method with data sources from books, KUHP, UU No. 44 Tahun 2008 regarding ponography and other documents, namely the judge’s decision No. 865 K/Pid.Sus/2013. This study uses a qualitative approach, data collection techniques were carried out by means of literature studies and interviews with members of the Karanganyar Police to find out cases of exhibitionism that occurred in the Karanganyar District. Data analysis is carried out by examining the data form of a narrative which is then linked to the theory in the legislation so that answers to the probems in this study are obtained. From this research, it was found that exhibitionism is an act of violating decency where exhibitionism perpetrators can be charged with Pasal 281 KUHP, Pasal 10 dan Pasal 36 UU No. 44 tahun 2008 regarding Pornography. The act can also be held criminally responsible according to Pasal 44 KUHP, because it is not included in the category of mental disorders/ diseases described in Pasal 44 KUHP. Efforts to overcome exhibitionism can be repressive methods.
