Abstract

This study aims to determine the basis for a consideration of the Boyolali Religious Court Judge in resolving marriage dispensation cases Number 321 / Pdt.P / 2020 / PA.Bi. and to find out the factors that underlie the rejection of applications for marriage dispensation with Number: 1194 / Kua.1109.04 / PW.01 / VII / 2020. The method used in this research is a descriptive normative approach because the research uses the law on marriage, Law no. 1 of 1974. Data collection uses by collecting and compiling primary, secondary and tertiary legal materials relating to marriage dispensation. Data analysis in this study was carried out using qualitative data analysis methods. This method is carried out by studying literature books, literature related to marriage dispensation. The results of this study are the legal basis for the consideration of the Boyolali Religious Court Judge in deciding the case of marriage dispensation Number 321 / Pdt.P / 2020 / PA.Bi referring to article 7 paragraph (1) of Law No. 1 of 1974 concerning Marriage. The basis for the judge's consideration used by the Boyolali Religious Court in deciding case Number 321 / Pdt.P / 2020 / PA.Bi is one of which is article 49 paragraph (1); (2) Law no. 7 of 1989 experienced a change in Law no. 23 of 2006. The judge's consideration underlying the grant of the marriage dispensation application Number 321 / Pdt.P / 2020 / PA.Bi was due to the KUA rejection of the dispensation of underage marriages who intend to marry. This can be seen in article 7 of Law No. 1 of 1974 concerning Marriage and 15 paragraph (2) KHI. however, giving dispensation or leniency on the request to the applicant. In granting the request for dispensation of marriage, the Panel of Judges saw the physical and mental condition of the applicant's child whether or not to marry. Because it is very important to know the valid reasons for giving consent to dispensation of marriage.
