Abstract

A work agreement is an agreement between a worker/labourer and an entrepreneur or employer that contains the terms of employment, rights, and obligations of the parties as regulated in Law Number 13 of 2003 concerning Manpower. The work agreement used in this study is a Work Agreement for a Certain Time (PKWT). This study aims to determine the rights and obligations between the Surakarta City Government and the TKPK in carrying out a contract system and find out the legal consequences and settlements if the TKPK violates the agreed agreement. This study uses an empirical juridical method approach because this research is aimed at the effectiveness of the law which will later discuss how the law operates or its implementation directly in society. This type of research is descriptive because this research clearly describes the work agreement on legal responsibilities between the Surakarta City Government and the TKPK at the Surakarta City BKPPD. The results of this study indicate that the rights of employers to get good work results from workers, obligations of employers to provide wages, leave and health and employment protection to workers, rights of workers to receive wages and protection, obligations of workers to comply with requirements in the workplace in accordance with the work agreement letter. If the employee violates the agreement that has been agreed regarding default due to error/negligence, the problem is resolved by way of deliberation by both parties, can be subject to a written warning sanction or be summoned directly. If the problem is related to an unlawful act, it will be resolved through legal procedures by the two parties concerned and the legal consequences in accordance with applicable regulations.
