Abstract

This study aims to describe the implementation and problems in the process of protecting the copyright of photographic works by Law Number 28 of 2014 concerning Copyright. The approach method used in this research is empirical juridical. The types of data are primary and secondary data. The data analysis method used in this study is a qualitative method. The results of the study concluded that the results of photographic works have obtained copyright protection based on article 40 paragraph 1 letter k of Law Number 28 of 2014 concerning Copyright. The problem that occurs is that this regulation is actually quite good and is sufficient to protect the rights of photographers as creators and copyright holders, but there are still many photographers and the public who do not understand or even know that photo works have been protected. There are still many violations that occur in the field practice of photographers such as piracy, copying and use without permission, enough to prove that copyright enforcement and protection are still hampered. This obstacle is caused by the low legal understanding and legal awareness of photographers and the public on the importance of respecting the rights of others, this becomes an obstacle in the process of enforcing copyright law.
