Abstract

Credit is the provision of money or equivalent claims, based on an agreement or loan agreement between a bank and another party that requires the borrower to repay the debt after a certain period of time with interest. People who make loans to banks are hereinafter referred to as debtors and the banks that finance these loans are then called creditors. Between the debtor and the creditor first enter into a credit agreement to obtain the requested funds. Credit agreement as the main agreement, where there is an agreement between the debtor and creditor in the form of a legal relationship. The granting of Mortgage is preceded by a promise to provide Mortgage as a guarantee for the settlement of certain debts, which are set forth in and are an inseparable part of the relevant debt agreement or other agreements that give rise to the debt. Registration of Mortgage is regulated in Law No. 4 of 1996 concerning Mortgage which is carried out manually and conventionally. However, along with the development of technology that is growing and advancing, the registration of mortgage rights has changed where the registration is carried out electronically. The purpose of changing the mortgage registration service system which is carried out electronically is to implement an electronically integrated mortgage service in order to improve mortgage services that meet the principles of openness, timeliness, speed, convenience and affordability for public services of Electronic Mortgage Rights or HT-el that for the first time regulated in the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 9 of 2019 concerning Electronically Integrated Mortgage Services and comes into force from the date of promulgation, which is 21 June 2019. Electronically Integrated Mortgage Services, hereinafter referred to as the HT System -el is a series of mortgage service processes in the context of maintaining land registration data which is carried out through an integrated electronic system.
