Abstract

Land procurement is one form of activity to obtain rights to a land by providing compensation to those who want to surrender or release buildings, land, plants, and or objects related to their land. So that in land acquisition, what is meant is the activity of providing land by providing proper and fair compensation by the government to the people who are entitled to receive it. The research method used in this study is a qualitative research method, which is a social science research method that collects and analyzes data to calculate or quantify qualitative data that has been obtained and thus does not analyze numbers. Sources of data were obtained directly from research sources on the subject or process that occurred in the field as a source of information which was examined by interviewing the actors of land acquisition for the Solo-Yogyakarta Toll Road, in Kadirejo Village, Karanganom District, Klaten Regency. Secondary The view of Islamic law regarding land acquisition in the public interest of the construction of the Solo-Yogyakarta Toll Road project is in accordance with Islamic law (syara'), namely there is no coercion from any party and the land owner willingly voluntarily relinquishes his land rights because it has gone through various deliberation. This kind of practice is a manifestation of Istihsan Bi Al-Maslahah Al-Mursalah, which is to leave a general law for a greater benefit for humans. Data sources used in this research are reference books, research results in the form of reports, observations, internet media and existing documentation. Data collection techniques used in this study using interview, observation, and documentation techniques. Then the data analysis technique uses the normative descriptive data analysis method, in addition to using the normative descriptive analysis method, the author also uses the deductive method, namely compiling the data obtained into general conclusions when conducting research.
