Abstract

Indonesia is one of the developing countries that is doing very high infrastructure development in all fields. So that companies in Indonesia need productive workers with the qualifications needed by a company, this can help improve the living standards of the Indonesian people for the better and can realize the welfare of the community. The purpose of this research is to find out the process of implementing a work agreement/Specific Time Work Agreement (PKWT), rights and obligations as well as applicable labor regulations, as well as knowing the legal responsibility if one of the parties makes a mistake in carrying out a certain time work agreement. The approach method used is based on legal research using a normative approach that examines legal principles, legal aspects, and legal rules for the implementation of a Specific Time Work Agreement. This research is descriptive because the research thoroughly explains the regulations on the process and the implementation of legal responsibilities in the implementation of work agreements/work agreements for a certain time. The results of the study stated that in the process and implementation of a work agreement/work agreement for a certain time, the regulations that govern it must meet. The administrative requirements and legal requirements contained in Article 52 paragraph (1) of Law no. 13 of 2003 concerning Manpower. Then the agreement occurs with the signing of a work agreement / work agreement for a certain time made by the company based on a standard agreement. So that with the agreement of the parties, it creates a legal relationship to carry out the rights and obligations. Workers' rights are an obligation of PT Yogma Wijaya Kusuma. Likewise, the company's rights are the obligations of workers. If one of the parties makes a mistake in the work agreement for a certain time, because it does not fulfill its obligations, it must be able to be responsible on the basis of default and if in carrying out the work it violates the applicable regulations and does not have good intentions in carrying out the work agreement for a certain time, then it can be accounted for. based on unlawful acts.
