Abstract

A partnership agreement occurs between two or more parties in which the parties have agreed on the provisions that have been made in terms of partnership cooperation to do something. One example of partnership agreement is the partnership business of Waroeng Spesial Sambal (SS) or can beknows as (SS). The problems contained in this partnership agreement is regarding the implementation of the partnership agreement between the two parties and legal protection for business partners in the event of non performance of contract by the business owner of Waroeng Spesial Sambal (SS). This study uses a normative judicial approach where the primary data source is the Waroeng Spesial Sambal (SS) partnership agreement and the secondary data source is other data related to the catering service partnership agreement using descriptive research. From this study, it was found that this partnership agreement has fulfilled the legal requirements of the agreement and the principles of the agreement according to Kitab Undang-Undang Hukum Perdata. However, there are still non performance of contract by the business owner of Waroeng Spesial Sambal (SS) and there are also force majure (overmacht) due to the Covid-19 pandemic.
