Abstract

Online transportation services are one of the growing businesses in Indonesia. Online transportation as a service makes it easier for people to travel, order food, and deliver goods. This study aims to find out how the legal sanctions against online motorcycle taxi consumers who have bad faith are detrimental to online motorcycle taxi drivers according to the Criminal Code and the ITE Law, how legal efforts can be taken by online motorcycle taxi drivers in prosecuting and how legal protection should be obtained by drivers. online motorcycle taxi. This study uses a juridical and empirical approach. This type of research uses juridical-normative research. The results showed that fictitious orders will be followed up and submitted to the police if the losers are very large financially. Legal protection for online motorcycle taxi drivers who experience fictitious orders is still not strong, considering the regulation, both the Criminal Code which still refers to conventional transactions and the ITE Law which tends to refer to transactions between sellers and consumers. By law, legal protection received by online motorcycle taxi drivers who experience fictitious orders and cancellation of orders is carried out unilaterally by reporting to the police. Meanwhile, the protection provided by companies will be different. The protection provided by the company is in the form of reimbursement of money with a set of procedures.
