Abstract

Muamalah is everything that regulates the relationship between humans and humans (khubbu minannas) and muamalah is a contract in which humans are allowed to exchange benefits. In Islamic teachings, there are many types of muamalah, one of which is profit sharing or what is often known as mudhorobah, based on the aspect of mutual help. In a profit-sharing cooperation contract (mudhorobah) it can be said that the contract is valid depending on the fulfillment of the pillars and conditions of the contract. In the community, there is a lot of cooperation that occurs, including a cooperation for profit sharing (mudhoroah). However, in practice there is often a profit sharing that is damaged in the contract and makes the contract inappropriate. As in the practice of profit-sharing (nggadoh) goats that occur between BMT AC (pseudonym) and the community. Where in practice this occurs because of a zakat maal program carried out by the BMT AC (pseudonym) and in its administration it is carried out by means of sharing the results of goats or often known as "Nggadoh Kambing". The cooperation transaction for ngadoh goat at BMT AC (Pickname) took place with a meeting between the BMT and the recipient of the goat aid at the BMT office to explain the regulations for the ngadoh goat cooperation (akad) then the recipient of the aid was asked to sign with a stamp as proof if both agreed to the contract. The cooperation of this goat gadoh is then continued with the handover of the mother goat that has been made into a contract. Based on the above background, the main problem arises, namely how the practice of the existing ngadoh goat practice system in BMT AC (Picony Name) and how the legal practice of goat ngadoh in BMT AC (Picony Name) is reviewed using a mudhorobah contract. The research method that the author uses is field research (field research). To find valid data the author uses data collection methods through interviews, observation and documentation. While the analysis technique used is qualitative data analysis, meaning descriptive research and how to solve research problems by describing the state of the object being investigated as it is based on the facts. The results showed that in its implementation it was not fully in accordance with the profit-sharing contract (mudhorobah), because in practice, the goat whose ownership rights to the goat were handed over to the penggadoh at the time of the initial contract. And the maintenance and care is borne by the creator. This is what makes this profit-sharing collaboration not in accordance with the Mudhorobah Agreement. Because the contract that occurs is not in accordance with the pillars and conditions for profit sharing so that the practice is more directed to a gift without having to ask for return/profit sharing.
