Abstract

In everyday life, land is something very important and valuable. So that not a few people want to master it. Because humans are social beings who cannot live alone and always need the help of other people who in their daily activities cannot be separated from the land. The purpose of this study was to determine the process and implementation of the village treasury land lease agreement in Brangkal Village. To find out the regulations, rights and obligations in the Village treasury land lease agreement in Brangkal Village which is carried out using an auction system and to find out legal responsibility if there is an illegal act in the land lease agreement for land in the village of Brangkal, Karanganom sub-district, Klaten district. The research method used in this study is the normative approach because what will be examined is the legal principles, the legal principles of renting the village treasury land so that it can be seen the legality of the process of implementing the village treasury land lease and its responsibilities according to law. This type of research is descriptive research because it intends to describe thoroughly the process and implementation of renting village treasury lands in Brangkal Village, which is carried out using an auction system.The results of this study indicate that the process of land lease agreements for village treasuries in Brangkal Village is carried out using an auction system, which begins by registering as an auction participant. After that the participants take part in the auction at the specified time. After the participant becomes the winner of the village treasury land lease auction, they must sign an agreement that has been prepared by the Brangkal Village government. After the agreement is signed, the rights and obligations will arise between the two parties. The Village Government as the renting party has the right to rent money and is obliged to hand over the Village treasury land to the tenant. If one of the parties makes a mistake or violates an agreement, it is resolved by deliberation. If not, the aggrieved party can file a lawsuit at the local district court on the basis of default and illegal actions if they violate the process of making the agreement or regulations that are not stated in the agreement.
