Abstract

The Sale and Purchase Agreement (PPJB) with the object of sale and purchase of the transfer of land rights is one of the agreements that has the potential to create conflicts. Due to the absence of specific arrangements regarding PPJB in the Civil Code, the agreement which is included in the category of anonymous agreement can cause confusion among the community. This study aims to determine the suitability of PPJB deeds made by notaries with the existing regulations in the Civil Code. The research method used is to describe the contents of the agreement in the form of subject clauses, objects, rights and obligations of the parties, as well as default clauses then reviewed using the regulations regarding the agreement contained in the Civil Code along with some expert opinions. From the research conducted, it has been found that the Land PPJB is a binding agreement for the parties who made it and is recognized as a legally binding evidence because it fulfills the articles of agreement in the Civil Code.
