Abstract

This study aims to determine the implementation of the copper handicraft export agreement based on the delivery system of goods between copper craftsmen and buyers in Tumang village and to find out how the responsibilities of the parties in the export agreement are. In this study, using an empirical juridical approach. This research is descriptive in nature with the intention of providing complete data regarding the implementation of the export agreement and the provisions therein. Based on the results of the research, it shows that the implementation of the copper handicraft export agreement has been made in accordance with the export contents of the agreement that has been agreed upon. The agreement is considered valid in the eyes of law because the agreement was made on the basis of a mutual agreement without coercion from any party. The export agreement is in accordance with the trade contract which contains the agreement and documents that can be attached to the shipping process through the destination port. These documents are to complete the files so that the goods can pass through the port of destination which is outside the country. The process of sending goods is also carried out according to the agreement between the two parties in which the buyer uses the process of the delivery system of the desired goods. The responsibilities of the parties in the copper export agreement are carried out in accordance with the delivery system of what goods are selected and efforts in dispute resolution are carried out by negotiation, if these efforts are not successful, then the parties choose the legal route, but usually using negotiation efforts alone is sufficient because at this stage the parties have been able to solve the problem.
