Abstract
Legal relationship between PT. Unggul Patra Santosa and Pangkalan Ratih Prasetya Dewi were preceded by a cooperation agreement for the distribution of 3 kilograms of LPG gas which refers to the principle of freedom of contract. The agreement for the distribution of 3 kilograms of LPG gas is a standard agreement because the agreement was made by PT. Unggul Patra Santosa as the 3 kilograms LPG agent while Ratih Prasetya Dewi only has to agree or not to the agreement offered by PT. Excellent Patra Santosa. If the Ratih Prasetya Dewi has agreed and signed a letter of agreement for the distribution of LPG 3 kilograms made by PT. Superior Patra Santosa, the two parties are bound to have a legal relationship, namely exercising their respective rights and obligations as well as responsibilities that must be carried out in accordance with the contents of the agreement. If the rights and obligations of the parties have been carried out, the legal consequences have been resolved, but if the rights and obligations are not carried out by one of the parties or if one of the parties makes a mistake because it violates applicable regulations, morals and public order then the legal consequence is that party must be responsible. The approach method used in this research is normative juridical method. Because in this research what will be examined are legal aspects, legal principles, legal principles, and regulations related to the cooperation agreement for the distribution of 3 kilogram LPG gas. This research is descriptive in nature because in this study it describes and extracts data systematically, factually, and thoroughly regarding the juridical analysis of the cooperation agreement for the distribution of 3 kilograms LPG gas between PT. Superior Patra Santosa with Pangkalan Ratih Prasetya Dewi and its legal consequences. The results of this study indicate that there are three stages, namely: before an agreement is made, when an agreement is made, and after an agreement is made. The agreement of the parties creates a legal relationship to exercise the rights and obligations of each party. If the cooperation agreement for the distribution of 3 kilograms LPG is violated by one of the parties because it does not fulfill obligations and violates applicable regulations, then the party who made the mistake must be responsible based on default as stipulated in Article 1243 of the Civil Code and acts against the law as regulated in Article 1365 of the Civil Code.
