Abstract

This research is intended to uncover the opinions which are more sound according to Imam al-Qurthubi regarding the interpretation of chapter al-Maidah, in His book of tafseer al-Jami’ li Ahkamil Qur’an, added with the implementation in contemporary cases. The writer uses the library study which he tries to analyze the opinions chosen by Imam al-Qurthubi in Islamic Law cases in part of chapter al-Maidah, and followed by applicationized in contemporary settings. One of the most important finding is that Imam al_Qurthubi allows of using any tools for slaughtering as far as the tools are functioned to drain blood (by cutting the throat and the esophagus) and cutting the neck veins, not included teeth and nail. Slaughtering by using electric shock is forbidden, as it is considered not functioned as draining the blood (by cutting the throat and esophagus). In the case of a robber, Al-Qurthubi argued that the leader of a state is given a punishment right free of choice which includes the cutting of leg and arm in the intersect way, or killed or crucified or jailed. And in the case of gambling, he said that is unlawful, as it is contain gharar (obscurity), and it is considered part of the business law. Regarding online business he argued that it is assumed ghaib ‘ala shifat (goods which is absent but has certain known characteristics) and it is allowed, as far as the seller is able to explain the features, supported by pictures or original photographs, and the buyer has a right for canceling buyings as the goods are considered not accordance with the promise of seller.
