Abstract
The higher the awareness of studying, the more demands are made to build boarding houses around the education location. Someone will use the boarding house to become a temporary residence for those who are working or who are continuing their education outside the city. Rent to rent a boarding house to enjoy boarding facilities within a certain period of time is carried out with an agreement between the boarding house owner and the boarding house tenant. This study aims to determine the boarding house rental agreement process at Wisma Ratu Rizky, knowing the application of the rules, rights and obligations of the parties in the boarding house rental agreement at Wisma Ratu Rizky, knowing legal liability if one of the parties makes a mistake on the basis of Default and Actions against The law in the rent rental agreement at Wisma Ratu Rizky. This study uses a normative approach, because what is being studied is legal principles, legal principles in legal responsibility for the implementation of rent-a-boarding house at Wisma Ratu Rizky. The nature of this research is descriptive analysis because in this research the writer will explain thoroughly and systematically the legal responsibilities of implementing the rent rent of Wisma Ratu Rizky boarding house. The results showed that the implementation process of the boarding house rental agreement before the agreement of the parties, namely the boarding house owner and the boarding house tenant, must meet several requirements including administrative requirements and legal requirements. If these conditions have been met with an agreement between the rental of the boarding house between the owner of Wisma Ratu Rizki and the tenant, then an agreement is made, by signing the boarding house rental agreement by both parties, then at that time a legal relationship arises from each party and will give birth rights and obligations for both parties. The regulations in the process of renting a boarding house rental agreement between the two parties must meet several legal requirements stipulated in Article 1320, furthermore the rights and obligations between the parties are regulated in Article 1560, Article 1564, Article 1551, Article 1552, then Article 1243 concerning Default , and Article 1365 concerning Unlawful Acts in the Civil Code. In a boarding rental agreement, if there is a party that does not carry out its obligations because it has committed a mistake and has committed an action that is not in accordance with the regulations in the boarding house rental agreement, which results in losses felt by one of the parties, then the party the person who commits an error must have responsibility based on default and unlawful acts, if so then he must compensate according to law.
