Abstract

Fiduciary Guarantee is a guarantee for movable or tangible or intangible objects as well as movable objects that cannot be encumbered with mortgage rights. In this research, the form of fiduciary security studied is shares. Therefore, the research aims to: a) How is the Legal Standing of Shares as the Object of Fiduciary Guarantee in the Credit Agreement? b) What is the Process and Fiduciary Impact of Shares as Collateral in the Credit Agreement? By using the approach method used in this study is the juridical-normative method, because in this study what will be examined are legal principles, legal principles about the explanation of the credit agreement fiduciary guarantee. This type of research is descriptive, that is, to clearly describe the explanation of stocks as a fiduciary credit agreement. The result of this research is to know the legality of shares as fiduciary collateral in the credit agreement, where it is known that the formulation "Article 1 of Law 4/1996 + Article 1 of Law 42/1999 + Article 60 (1) of Law 40/2007 + Article 60 (2) of Law 40 / 2007 + Article 52 of Law 40/2007 ”. And the stage of the share submission process as fiduciary security in the credit agreement is contained in Articles 1, 5, 6, 11 to 15 of Law Number 42 of 1999 concerning Fiduciary Security.
