Abstract

Fiduciary security is a property security right for movable or immovable objects that cannot be encumbered by the security right regarding the control over the object remains with the fiduciary. There is a fiduciary guarantee in murabahah financing to guarantee the repayment of the financing provided and to give priority to other creditors. This study uses an empirical juridical approach. In this study, the authors will provide descriptions of the implementation of fiduciary security in murabaha financing at BMT Mulia. Fiduciary bonding in murabahah financing must be in accordance with the provisions of the applicable laws. By registering a fiduciary guarantee, it can provide protection and legal certainty to the parties involved in financing. In this research it can be concluded that the inclusion of fiduciary guarantees as a condition in applying for murabaha financing is allowed. The binding of fiduciary guarantees in murabahah at BMT Mulia is carried out by under-hand agreement without any registration at the fiduciary registration office. Settlement of defaults in murabahah financing is carried out by deliberation and legal remedies through s religious court.
