Abstract

Technological developments have influenced human life and one of the technological developments in the information and communication sector is the internet. Internet is a network of networks (networks of networks), namely E-commerce has covered the entire commercial spectrum such as financial technology (fintech). financial technology has not only developed in the conventional sector but has also been present in sharia-based fintech. Since the issuance of the Fatwa of the National Sharia Council of the Indonesian Ulama Council Number 11 / DSN-MUI / II / 2018 concerning Information Technology-Based Financing Services based on sharia principles, it indicates that Islamic financial technology transactions have received government attention. The existence of the MUI DSN fatwa is fundamental considering that Indonesia is a country with majority Muslim population. So that regulators have the responsibility to protect the economic interests of the community, in this case, especially Muslims so that in transacting on fintech, they avoid maghrib elements (maisir, gharar, and usury). The purpose of this research is to explain the profile of Islamic Financial Technology financing and Sharia Fintech Financing Agreement based on DNS-MUI rules Number 117 / DSN-MUI / II / 2018. In this study, the authors used this research is a juridical-normative research. This study examines existing library materials in the literature and regulations related to this research. This research results in conclusions from the financial technology financing profile registered with the OJK as a whole which brings together fund owners and parties who need online funding through e-commerce or the marketplace who are in the management or control of the fintech platform and contracts that are built based on the principles of Islamic principles. The validity of Sharia Financial Technology that is registered with the Financial Services Authority is broadly in accordance with the MUI DSN Fatwa Number 117 / DSN-MUI / II / 2018. However, the settlement of Sharia Fund disputes is carried out at the District Court, while in the DSN fatwa No. 117 / DSN-MUI / II / 2018, it explains that dispute resolution is carried out through dispute resolution based on sharia principles, namely in the Religious Court or Arbitration. And also the Qazwa financing platform cannot be said to be fully in accordance with the MUI DSN Fatwa Number 117 / DSN-MUI / II / 2018
