Abstract

Mu'amalah is a very broad field of Islam to study and also closely related to doing business and trading. In buying food, people prefer places that provide many menus and affordable prices. Kedai Abdullah is one of the restaurants that is in great demand by buyers. However, in reality the food is bought and sold at sell without price quotation. It can be said that buying and selling of some kind it contains an element of disguise, due to the lack of deep price transparency implementation of the sale and purchase resulting in the cancellation of the contract because elements were not achieved willingness element. As explained in article 29 KHES that the contract valid as referred to in article 26 letter (a) is the contract that was agreed upon in the agreement, does not contain elements of ghalath or error, done below ikrah or coercion, taghrir or hoax, and ghubn or disguise. That matter It can cause frustration to buyers especially when the price has to be paid was far from what was expected, the buyer also felt disadvantaged so that in the sale and purchase the element of willingness is not achieved. The problem in this research is how to carry out buying and selling food in restaurants without price inclusion at Kedai Abdullah Goro Assalam Kec. Kartasura Kab. Sukoharjo, what are the factors behind the exclusion of prices at Abdullah Goro Assalam shop, Kec. Kartasuran Kab. Sukoharjo and how to review the compilation of sharia economic law on the sale and purchase of food without price inclusion at Abdullah Goro Assalam shop, Kec. Kartasuran Kab. Sukoharjo. The purpose of this study was to determine the system of buying and selling food at Abdullah's shop, to determine the factors behind the exclusion of food prices at Abdullah Goro Assalam's shop, Kec. Kartasuran Kab. Sukoharjo and to find out the compilation of sharia economic law on food buying and selling at Abdullah Goro Assalam shop, Kec. Kartasuran Kab. Sukoharjo. This research is classified as field research (field research). Primary data were collected from interviews. The author uses a purposive sampling technique, namely the sampling technique of data sources with certain considerations. The author takes the available population, namely 3 people, namely the customer of Abdullah's shop and 1 of the owner of the Abdullah shop. Data processing was done through editing and systematization of data analysis done qualitatively with deductive thinking method.Based on the research results, it can be concluded that the implementation of selling buy food without price inclusion in the compilation of sharia economic laws allowed. As stated in article 78 KHES which reads several things that are included in the sale and purchase, even if not specified firmly in the co ntract in letter (a). The problem does not result in the sale and purchase being canceled, because of the transaction it has become a community habit that is difficult to avoid and already has a consensual basis. Because I have become a habit and have a consensual basis then this is allowed as long as it is does not violate the provisions of syar'i law.
