Abstract

The Government of the Republic of Indonesia throught the Ministry of Law and Human Rights issued a policy of assimilation of prisoners which has been legitimized by Regulation of Law and Human Rights Minister Number 10 of 2020 concerning the Provision of Assimilation and Integration Rights of Prisioners and Childen in the Context of Preventing and Controlling the Spread of Covid-19. The current spread of the Corona Virus has created various polemics in people’s lives. For example, the polemic regarding the assimilation policy of prisoners during the COVID-19 pandemic, which has resulted in various pros and cons reactions from the society. People who are pro think that this policy is a government step in an effort to protect the lives of prisoners as well as form of prevention and anticipation of the spread of the COVID-19 virus in the prison environment. As for the people who are opposed to this policy, they see that if prisoners get the right of assimilation, there is a concern that many crimes will occur in society in the current situation and condition. One of the goals of criminal law enforcement is to create a sense of justice, legal certainty and benefit in society. Protection of the life (hifdzu nafs) in Islam functioned based on the Maqasid Syariah, namely the 5 objectives of Islamic Law in order to maintain the benefit and peace of mankind.
