Abstract

This research is based on legal research conducted with a doctrinal approach and a type of normative juridical approach. The purpose of this research; a) to find out the position of children in law in Indonesia; b) to find out the position of children in law in Indonesia; c) to find out the arrangements of children's rights in Malaysia and America. The research results found are the position of children in Indonesian law regulated in the Indonesian Child Protection Commission (KPAI), this commission was formed on the basis of Law No. 23 of 2002 regulated in Articles 74-76 and through Presidential Decree No. 77 of 2003, Article 330 of the Civil Code, Law Number 35 of 2014 concerning Child Protection and Article 2 paragraph (1) of Law Number 23 of 2004 concerning the Elimination of Domestic Violence; Household scope. Right to support children in Decision Number 108 / Pdt. G / 2020 / PA. Clg Judge does not give a decision regarding the child's living rights with agreement. The right to support a child due to a divorce in the legal system in Indonesia is regulated in Law Number 1 of 1974 concerning Marriage, namely: Article 41 (c); The court can require the ex-husband to provide living expenses and determine an obligation to his ex-wife. The rights of Malaysian children are regulated in the 2001 Children's Deed (Deed 611). In America the American Declaration on the Rights and Responsibilities of Man (1948) adopted by the 9th International Conference of American States in Bogota in 1948 stated that all human beings are born free and equal, in dignity and character, and endowed with reason and conscience they must treat each other as brothers.
