Abstract

To realize law enforcement in the context of imposing sanctions / punishments for perpetrators of criminal acts, proceedings are required until a judge decides. This stage begins with an investigation and then enters the investigation process, after which the public prosecutor is making an indictment and the final stage is an examination in court until the judge decides. One of the implications for fair law enforcement is the provision of suspension to detained suspects. The provision of deferral is very dependent on the relevant agencies in providing suspension of detention. This research method uses an empirical juridical research method by referring to the regulations and doctors that apply to detention suspension and then explaining the existing data in the field by interviewing investigators as an agency that also has the authority to provide suspension of detention. The purpose of this research is to find out how the investigators consider a suspension of detention because the statutory regulations give full authority to investigators to provide a suspension of detention.
