Abstract
Abstract The study aims to determine the juridical review of the implementation of non-litigation legal assistance and the constraints faced in mentoring non litigation settlements. The method of approach used in this research is a descriptive method of empirical approaches. The data source used is primary data, which is the result of interviews with the related parties and secondary data in the form of prevailing laws and regulations. Data collection techniques with literature studies and interviews. Data analysis methods use qualitative data analysis methods. The results show that the juridical basis for the implementation of non-litigation legal assistance is based on: (1) The Law of the Republic of Indonesia No. 16, 2011 about legal aid for the recipient of legal assistance in which it is a person or group of poor people who face legal issues, (2) The Law of the Republic of Indonesia No. 48 year 2009 on Judicial authority, (3) Law of the Republic of Indonesia No. 49 Year 2009 on General Court, (4) Law RI No. 50 year 2009 on Second Amendment to LAW No. 7 year 1989 on religious Justice, ( 5) ACT No. 51 year 2009 About State Administration Judiciary, (6) Law of the Republic of Indonesia No. 18 year 2003 on Advocate, and (7) Law No. 8 year 1981 on the Code of Criminal proceedings. Furthermore, the constraints faced in mentoring non-litigation solutions include: (1) The Kekurangtahuan of society on the legal issues that override it, (2) Human resources are still lacking, both quality and quantity, and (3) Insufficient financing budget.
