Abstract

This research is based on cooperation field of plantations in Kembang Kuning Village, where there are garden owner who hand over their gardens to the workers to managed and divided between two of them by agreement. In Islamic Law or fiqh muāmalah is known as musāqah. Musāqah practice in Kembang Kuning Village is carried out orally and based on time. The main problem in this study is : 1) How is the practice of musāqah rubber garden in Kembang Kuning Village? 2) Is the practice of musāqah rubber garden accordance with Islamic law?. The purpose of this research is to explain the practice of musāqah rubber garden in Kembang Kuning Village and too see the suitability of the implementation of musāqah rubber garden practice in Kembang Kuning Village in Islamic law. The method of this research is field research, descriptive qualitative in the form of words and behavior through those observed . With an evaluative approach that use a comparison of the data that has been taken and then taken from the conclusion. Data sources obtained from primary and secondary sources. Data 2 collection through interviews, observations, and documentation. Once the data has been collected, the analysis of the data used is qualitative that outlines the problems, the drawn conclusions in a deductive way. From the research, it can be known that the implementation of musāqah practice in Kembang Kuning Village is accordance with Islamic law, because it has fulfilled the harmony and requirements of musāqah agreement. The distribution of the proceeds is carried out on the basis of mutual like-for-like based on mutual agreement that each gets a 50%:50%. Musāqah practice is carried out orally and without basis by the time of custom and agreement dalamof the owner and the tenant of the rubber garden in Kembang Kuning Village. So the garar element that appears is only garar qalīl which is agreed by the scholars on ability in accordance with customs of society. This has been accepted by community.
