Abstract

Divorce is the breaking of the marriage bond between a man and a woman as husband and wife, which is carried out in front of a court hearing after the court fails to reconcile the two parties and in a divorce there must be sufficient reasons why a husband and wife will not live in harmony. In one of the divorce processes there is a settlement through mediation, as regulated in PERMA No. 1 of 2016. However, mediation is still considered only as a formality in divorce cases. In the Surakarta Religious Court, the mediation success rate in divorce cases is only 2%. In fact, the pattern of dispute resolution through mediation is well known in the Islamic legal system. When there is a big conflict in the household that is difficult to resolve alone by a husband or wife. Islam has ordered both parties to break off the two hakam (peacemakers or mediators), with the intention of finding a way out. Although there are still a few who use mediation settlement, especially in the Surakarta Religious Court, it is hoped that the mediation settlement can be increased and effective. This study uses an empirical juridical approach.
