Abstract

Penelitian disertasi yang berjudul Desain Pengambilan Keputusan Majelis Permusyawaratan Rakyat Dalam Perspektif Demokrasi Permusyawaratan Berbasis Pancasila, akan mengkaji kedaulatan rakyat atau demokrasi modern adalah demokrasi dengan sistem representasi sebagai perkembangan dari demokrasi langsung. Demokrasi sistem representasi, rakyat akan memilih seseorang yang ada diantara mereka sendiri untuk menjadi wakilnya. Sistem kedaulatan rakyat, dirancang untuk memberdayakan peran penting lembaga perwakilan yang berkembang dengan kekuatan rakyat dan disesuaikan dengan nilai-nilai filosofis dalam kehidupan berbangsa dan bernegara. Disertasi ini bertujuan akan menganalisis dan menjelaskan telaah kritis kewenangan Majelis Permusyawaratan Rakyat (MPR) sebelum maupun sesudah amandemen Undang-Undang Dasar 1945. Serta menemukan konsep Desain Pengambilan Keputusan MPR dalam Perspektif Demokrasi Permusyawaratan yang Berbasis Pancasila. Penelitian ini menggunakan jenis penelitian yuridis normatif, yaitu meneliti peraturan perundangan yang memberikan atribusi kewenangan kepada MPR, terutaman kewenangan terhadap pengambilan keputusan, yang secara khusus melahirkan keputusan yang berdampak hukum, apakah sudah sesuai dengan prinsip-prinsip demokrasi permusyawaratan. Hasil dari penelitian disertasi ini adalah pada dasarnya Negara Indonesia, telah mengenal tatanan kehidupan demokratis sejak sebelum negara Indonesia lahir, yaitu kedaulatan rakyat atau demokrasi berdasarkan pada nilai-nilai pertimbangan untuk mencapai konsensus.Pembangunan, demokrasi di Indonesia, sistem modern mengarah ke liberalisme (barat / pemilihan) telah menggesesr sistem tradisional (musyawarah).Telaah kritis yang dilakukan terhadap kewenangan pengambilan keputusan MPR baik sebelum maupun sesudah amandemen Undang-Undang Dasar 1945, serta keterlibatan pihak dan mekanisme dalam pengambilan keputusan di MPR. Sebab sejauh pengamatan yang dilakukan oleh penulis, mengenai tata cara pengambilan keputusan dalam prakteknya yang dilakukan oleh Majelis Permusyawaratan Rakyat (MPR) lebih condong kepada demokrasi barat dengan mengedepankan voting (suara terbanyak) dan tidak sejalan dengan demokrasi permuyawaratan berbasis Pancasila serta tidak mengandung nilai-nilai kedaulatan rakyat. Rekomendasi yang diberikan dalam penelitian ini adalah perlu adanya perbaikan yang mendasar untuk mewujudkan demokrasi permusyawaratan yang berbasis Pancasila dalam kehidupan berbangsa dan bernegara, yaitu antara lain; kehidupan manusia, mental-spiritual, institusional-politikal dan material-tehnologikal. Disamping itu, perlu adanya amandemen terhadap UUD 1945 yang mengutamakan pada pelaksanaan prinsip demokrasi kelembagaan perwakilan rakyat (MPR, DPR, DPD). ABSTRACKT The dissertation research entitled The People's Consultative Assembly Decision Making Design in the Perspective of Pancasila-Based Deliberative Democracy, will examine the sovereignty of the people or modern democracy is democracy with a representation system as a development of direct democracy. In a democratic representation system, the people will choose someone among themselves to be their representative. The system of people's sovereignty is designed to empower the important role of representative institutions that develop with the power of the people and are adapted to philosophical values in the life of the nation and state. This dissertation aims to analyze and explain a critical analysis of the authority of the People's Consultative Assembly (MPR) before and after the amendments to the 1945 Constitution. As well as discovering the concept of MPR Decision-Making Design in a Pancasila-Based Deliberative Democracy Perspective. This research uses normative juridical research, which examines the laws and regulations that assign authority to the MPR, especially the authority over decision making, which specifically produces decisions that have legal implications, whether they are in accordance with the principles of deliberative democracy. The results of this dissertation research are that basically the Indonesian State has recognized the democratic life order since before the Indonesian state was born, namely people's sovereignty or democracy based on the values of consideration to reach consensus. Development, democracy in Indonesia, the modern system leads to liberalism (western / election) has shaken the traditional system (musyawarah). The critical review carried out on the MPR's decision-making authority both before and after the amendments to the 1945 Constitution, as well as the involvement of parties and mechanisms in decision making in the MPR. Because as far as observations made by the author, regarding the procedures for decision making in practice carried out by the People's Consultative Assembly (MPR) is more inclined towards western democracy by promoting voting (most votes) and is not in line with Pancasila-based democracy and does not contain values. population sovereignty. Recommendations given in this study are that there is a need for fundamental improvements to realize Pancasila-based democracy in the life of the nation and state, namely; human life, mental- spiritual, institutional-political and material-technological. In addition, there is a need for amendments to the 1945 Constitution which prioritizes the implementation of democratic principles of people's representative institutions (MPR, DPR, DPD).
