Abstract

Mediation is a way of resolving disputes through the negotiation process to obtain agreement between the parties, assisted by a mediator. In 2016 the Supreme Court issued Perma No.1 of 2016 concerning Mediation Procedures in Courts which contained new provisions that were different from the previous Perma as an effort to improve the optimization and effectiveness of mediation in court. The purpose of this research was to determine the implementation of Perma No.1 of 2016 in the Surakarta District Court. In this study, researchers used an empirical juridical approach in which the researcher analyzed the problems by combining legal materials which were secondary data with primary data obtained in the field. The results of the study show that the procedure for implementing mediation at the Surakarta District Court has been carried out according to Perma No.1 of 2016 but is still not effective, this can be seen from the relatively low success rate of mediation. The factors inhibiting the effectiveness of mediation in the Surakarta District Court, namely the conditions of the parties themselves and the cases that were already so complicated and complex. These things then make the implementation of mediation at the Surakarta District Court ineffective and difficult to materialize.
