Abstract
The study aims to determine if the cause of the child to commit a criminal offence narcotics, knowing if all the children of narcotic abuse of the drug will be in the end with a prison sentence verdict, and know what is the basis of the judge's consideration in providing rehabilitation of the child drug abuse perpetrators. To achieve that goal researchers have conducted research using the type of research used is to use qualitative descriptive research and method of approach used that is using normative juridical approach method. The results of this study abusers narcotics are obliged to be punished in accordance with article 127 paragraph (1) of law No. 35 year 2009 concerning narcotics but because of children who become perpetrators of narcotics crime then in the criminal justice process using law No 2012. So that the judge in consideration of a prison sentence or give rehabilitation to the child doer abusers narcotics see from the condition that relieve and incriminate defendants.
