Abstract

This thesis discusses Tarjihat Ash Shobuni in his book Rowai'ul Bayan about the laws of Hajj and Umrah as well as matters relating to both. What encourages the author to write this treatise are questions from the claimants specifically and from the people Lay people in general about Hajj and Umrah, also about how to know strong and not strong opinions regarding fiqh discussions on ahkam verses, and also to make it easier for prosecutors to take advantage of books written by Ash Shobuni in his book by using his Tarjihat method on problems that have differences of opinion in it, especially around the laws relating to Hajj and Umrah with methods that are easy and brief, and to facilitate in understanding the Koran. The purpose of writing this thesis is to find out the Tarjihat Ash Shobuni in his book Rowai'ul Bayan especially around the laws of Hajj and Umrah, to find out his Tarjihat method, and also to find out the advantages of his Tarjihat related to discussions of fiqh on ahkam verses around the laws of Hajj and Umrah. And the most important thing from this thesis is: Ash Shobuni is among those who are very concerned with the study of the Koran from the ulma 'contemporary, and his view is to choose a more opinionate opinion by Tashih or Taswib, justifying the opinion among the opinions that different, strengthen one opinion or prioritize it from another opinion, and by bringing an opinion that shows the effectiveness of the opinion. And the Qo'idah Tarjih which he uses are: Tarjih according to the zhohir of the Koran or As-Sunnah, or with Qiyas, or by choosing the Ahwat, or according to the Arabic zhohir; and his Tarjihat has not covered all the problems of Hajj and Umrah. And the strength of his Tarjihat related to fiqh discussions on ahkam verses around the laws of Hajj and Umrah is the easy and concise method of Tarjih.
