Abstract

Mediation as one of the court proceedings carried out as an effort to reconcile between the parties who litigate. The implementation of this mediation is expected to be able to resolve the case without having to proceed to the next trial. With so many cases being resolved in mediation, the implementation of mediation in court can be said to be effective. The purpose of this study is to determine the effectiveness of the implementation of mediation in the Magetan Religious Court both in terms of Perma Number 1 Year 2008 and Perma Number 1 Year 2016. This research is a type of field research, so in this study researchers used a qualitative approach get accurate data. The results of the study indicate that the implementation of mediation in the Magetan Religious Court both in terms of Perma Number 1 Year 2008 and Perma Number 1 Year 2016 when viewed in terms of its use, then the implementation of the mediation has been effective because within one year about 29% of divorce cases were revoked during the trial. Meanwhile, if viewed in terms of results, the implementation of mediation in the Magetan Religious Court could not be said to be effective. It was said so because within a period of 1 (one) year the success rate of mediation did not reach 1%.
