Abstract
One of the services of Financial Technology (Fintech) namely Lending and Borrowing Money Based on Information Technology (peer to peer lending) has been favored by the people of Indonesia. Therefore OJK in carrying out its functions has issued Regulation Number 77 / POJK.01 / 2016 concerning Information Technology Based Money Lending and Borrowing Services. The purpose of this study is to examine the legal protection for the parties in fintech services to the laws and regulations including the Financial Services Authority regulations. This research uses the doctrinal approach method with descriptive research type. Which will describe the extent of the legal protection aspects of the parties in an information technology-based money lending and borrowing agreement. The results showed that in the loan agreement to borrow money based on information technology there are still several aspects that do not meet the rules of legal protection for both creditors and debtors. Therefore the government needs to make a concrete and firm legal umbrella in the implementation of Peer to peer lending in Indonesia, as well as the people who must be more selective in choosing fintech companies.
