Abstract

The use of the right of ex officio judge in divorce divorce cases where the judge in Decision Number 1556 / Pdt. G / 2018 / PA. Klt. using its ex officio rights in making decisions regarding the Respondent's claim, the Judge only granted a portion that was not in accordance with the nominal demands of the Respondent and the ability of the Petitioners where the Respondent wanted beyond the capabilities of the Petitioner, it was not in accordance with a sense of justice and propriety. The panel of judges ex officio may punish the Petitioner to pay mut'ah and livelihood for the Respondent. Perspective of Islamic Law Against the Use of Ex Officio in Divorce Divorce Cases in Article 24 and Article 25 of the 1945 Constitution of the Republic of Indonesia, Qs. An-Nisa / 4: 58 and Rasulullah SAW said; "By Allah, in fact we will not authorize this task (judge) to those who ask for it or those who have ambitions to take office." (HR Bukhari Muslim).
