Abstract
The desertion crime is a criminal act specifically carried out by a military by leaving unity without legal permission from the competent authority within a minimum grace period of 30 days in a row. Military justice which is a judicial institution within the military must ensure a fair legal process for members of the military and enforce discipline among members of the military. Maybe people think that military law is enough to be known by the military alone, but also not entirely true because the military is part of a society or nation. A TNI soldier is required to be able to complete the duty of service to the nation and state well and ends without blemishes. The slightest violation committed by members of the TNI will certainly reduce the image of TNI soldiers in the eyes of the public. This writing uses a qualitative descriptive method. Analyzed descriptively qualitatively to get dissimilarities or similarities from research in the field with the applicable regulations and then conclusions can be drawn. The conclusion was taken using the deductive method, by looking at the regulations governing the crime of desertion and its application in the Yogyakarta Military Court.
