Abstract

Information technology is not only able to increase the progress of development, prosperity and civilization, but also can cause negative changes that are not in accordance with the rules of law that have been in force. The form of criminal acts that occur in the community is a criminal act of decency in the field of Information and Electronic Transactions. The government issued Law No. 11/2008 on Information and Electronic Transactions (UU ITE). Therefore, the authors are interested in discussing the formulation of the problem how is the basis for the judge's judgment in dropping the verdict? What is the legal protection of Baiq Nuril (as a woman) for the issuance of a decision? What is the punishment for perpetrators of sexual harassment or decency in the perspective of Islamic law? The writer in the research uses the normative approach method. Normative research is research that refers to legal norms that contain laws and regulations, court decisions and norms or rules that live and develop in society. The conclusion of this study is that judges in deciding a case must pay attention to other provisions as a consideration, for the achievement of justice.
