Abstract

The main problem of this research is how the profit sharing system (muzara'ah) between land owners and farm workers in the Dawung village and and whether the system of distribution of revenue between land owners and farm workers in the Dawung village, Sambirejo District, Sragen Regency already in accordance with the Islamic legal system, the purpose of the study to analyze muzara'ah in applying the principle of profit sharing in the Dawung village and to find out the inhibiting factor for the application of the principle of muzara'ah in the agreement on agricultural profit sharing in the Dawung village, Sambirejo District, Sragen Regency. This type of research includes field research namely research that is directly on the ground or actual life specifically what is happening. In this study researchers directly researching, reviewing, and conducting interviews with landowners and farm workers related to the system of sharing the results of the muzara'ah carried out in the Dawung village, Sambirejo District, Sragen Regency, Central Java. Based on the results of research and data analysis, it can be concluded that the muzara'ah contract in the Dawung village, Sambirejo District, Sragen Regency between land owners and farm workers not in accordance with Islamic law. Because in practice the muzara'ah contract contains elements of gharar (obscurity) on the requirement relating to the harvest and there are fasid (broken) elements happened because there are requirement that are not fulfilled thus making the legal terms of the contract damaged.
