Abstract

Title of Claims for Divorce Due to Domestic Violence (Study of Decision 487 / Pdt. G / 2010 / PA. Ska) aims to: a) To find out the legal rules regarding divorce in applicable law in Indonesia; b) To find out the judge proves and is due to the decision of divorce from the applicant due to domestic violence. The approach used in this study is a normative method and the type of research used is descriptive. The result of this research is that the regulation regarding divorce is regulated in Law Number 1 of 1974 concerning Marriage and Compilation of Islamic Law. The judge in proving the divorce suit was based on the testimony of witnesses from both parties, both the witness' family of the Petitioner and the Respondent and the witnesses of other people, in fact the statements of each other corresponded to each other because of frequent quarrels caused by jealousy and mutual accusations of infidelity and there was domestic violence and as a result of the quarrel, at this time the two sides had separated the house for 2 years and the families of the two sides had tried to reconcile but were unsuccessful, each of them not wanting to maintain his household as husband and wife.
