Abstract

The aims of marriage is happy and eternal family. But the aims not to achieve because divorce. Such as the case divorce among the Female Labor (TKW). The aims of this research is knowing determine the reasons for divorce TKW and the consideration of judges in granting reason of divorce TKW be based on the court religion Magetan decision number 0720/Pdt.G/2018/PA.Mgt. The approach method is use normative, to examines application the regulations of marriage with the events in the decision and results of interview. The results of this research is the reason for divorce TKW is because of the ongoing disputes, economic factors, livelihood factors, and third-person factors. The considerations used by the judges is Article 19 letter (f) Government Regulation Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 concerning marriage and Article 116 letter (f) Compilation of Islamic Law, and Islamic law if both of them cannot be allied then divorce law becomes obligatory for both.
