Abstract

In a certain time employment agreement (PKWT) a prospective employee will be required to sign a work agreement, which results in the ruling on binding the prospective employee to the company. But often a prospective employee does not understand the content of the employment agreement and immediately signs the employment agreement with the reason for the need to get a job. In this research the author conducted a research on the work circled PT Pelindo Daya Sejahtera (PT PDS), the authors use the normative-empirical approach, which is the author to conduct an assessment of the contents of the PKWT with Law No. 13 of 2003 and Doing Quisioner with unions and employees about the contents of PKWT PT PDS, in a specific work agreement PT PDS with prospective employees is in accordance with the stipulated by LAW No. 13 of 2003 on employment, but there are some articles that is not appropriate and need additional as well as the article about tort and Overmacht.
