Abstract

ABSTRACT LEGAL PROTECTION AND ASASI RIGHTS AGAINST CHILDREN UNDER THE AGE AS THE ACTORS OF NARCOTIC CRIMINAL AT THE BAPAS SURAKARTA LEVEL The research aims to find out the mechanism of legal protection and human rights for minors who are perpetrators of narcotics crime based on the Act at the Bapas Surakarta level. This type of research is descriptive, which is to clearly describe the Legal Protection and Human Rights of Underage Children as Narcotics Criminals. Data analysis method used is normative-qualitative by compiling data collected including regulations, books, jurisprudence regarding Legal Protection and the Rights of Underage Children as Narcotics Actors analyzed qualitatively analyzed and then conclusions drawn. The results of this study are Handling as well as the right and proper treatment of children who commit crimes is very influential on the psychology of children. Therefore, it is needed the role of a special institution and special apparatus to deal with children who are dealing with the law both at the police, attorney, and court levels. In addition, it is important to remember that a crime committed by a child does not only harm the child itself but also harms the community. Constraints in communication, for BAPAS communication, it is really difficult, especially for clients who communicate in various languages, such as clients who live in the region, cannot use Indonesian, and clients who cannot speak Indonesian correctly, so communication between BAPAS and clients correctional facilities can not be integrated because of the language.
