Abstract
In the case of confiscation of inheritance land disputes that have not been divided and recognized as gono assets, this study aims to find out the procedure of carrying out resistance in the District Court for confiscation of inherited land disputes that have not been divided and recognized as gono-gini assets, to find out the judge's judgment in determining proof of the case of confiscation of the disputed land inheritance that has not been divided and recognized as gono-gini assets and to find out the judge determines the decision of the case of confiscation of land inheritance dispute that has not been divided and recognized as gono-gini assets. This study uses a normative approach, because in this study, the legal principles, legal principles regarding resistance to the confiscation of land inheritance disputes that have not been divided and recognized as Gono Gini assets. This type of descriptive research is to illustrate clearly the resistance to the confiscation of inherited land disputes that have not been divided and recognized as Gono Gini assets. The results show that the initial step that must be taken in a lawsuit against the District Court regarding a dispute over inherited land that has not been divided and recognized as Gono Gini assets is to prepare a lawsuit. The next step the Opponent must take is to register the lawsuit through the case registration section in the Surakarta District Court. Preparing lawsuits that have been made are listed for filing litigation accompanied by the reasons for the lawsuit. For a competitor to succeed, he must prove that the confiscated item is his. If he succeeds, he will be declared as a true contender and confiscated will be ordered to be appointed. Judge's Consideration in Determining Proof of the Case of Confiscation of Execution of a Legacy Land Dispute that has not been divided and recognized as Gono Gini's Assets that based on Article 35 Paragraph (1) of RI Law Number 1 of 1974 it is stated that assets obtained during marriage become joint property. In the case of confiscation of waria land dispute that has not been divided and recognized as Gono Gini assets, the judge considered that the resistance of the confiscation of the execution of the contender was declared rejected because the Opponent could not explain in full the amount / amount of compensation demanded and had to be paid to both First I and First II then the lawsuit demanding compensation and confiscation of execution of inherited land that has not been divided and recognized as gono assets cannot be granted or rejected by the judge.
