Abstract

Research on "Divorce on the basis of infidelity conducted by husband" uses a normative method which aims to find out the process of proving judges in divorce lawsuits filed by wives and find out the basis of judges in issuing decisions in divorce lawsuits filed by wives. The research results obtained in the case of Decision Number: 0112 / Pdt.G / 2018 / PA.Ska divorce on the basis of domestic violence in accordance with the legal basis Article 39 Paragraph (2) explained that to be able to divorce must have sufficient reasons, that between husband and wife cannot live in harmony anymore as husband and wife. Further implementation is regulated in Article 19 of Government Regulation Number 9 of 1975 concerning Implementing Regulations on Marriage Law Number 1 of 1974 The Judge considers that because the Plaintiff has stated to revoke the claim and revoke it at the Plaintiff's own wish, the panel of judges believes it is in accordance with the provisions of Articles 271 & 272 Rv. That the revocation is stated, the Plaintiff's claim must be declared finished, therefore, the revocation needs to be granted. Judge Considering, that because this case is included in the field of marriage, the judge is required not to use a formal approach just to discover the quantity and quality of disputes. Conversely, judges in carrying out the function of reconciliation, also look for and find the factors behind the dispute.
