Abstract

This study aims to determine the implementation of the cooperation agreement on CV.Arcana Saputra with Amakarama Furniture, and determine the settlement carried out by the parties in the event of default. This research uses an empirical juridical approach. This research is descriptive in nature with the aim of providing complete data regarding the implementation of the cooperation agreement and the provisions therein. The types of data used are primary and secondary. Based on the results of the study showed the implementation of the cooperation agreement between CV.Arcana Saputra with Amakarama Furniture was in accordance with the contents of the agreement that was agreed upon. The agreement is in accordance with the provisions of Article 1320 of the Civil Code. The implementation of the cooperation agreement between CV.Arcana Saputra and Amakarama Furniture is legal before the law and made without coercion. The form of the contents of the agreement is in accordance with the principle of the principle of freedom of contract which has been regulated in Article 1338 paragraph (1) of the Civil Code, in making it free but for everything according to the nature of the agreement is required by propriety, customs or laws stipulated in Article 1339 of the Civil Code. Settlement of defaults in the cooperation agreement between CV.Arcana Saputra with Amakarama Mebel to resolve the issue by means of a family consultation, and efforts to provide a solution. If the effort is unsuccessful, the parties agree to choose the legal residence of the District Court.
