Abstract

Marriage aims to create a happy and eternal family. Divorce can only be done if there are certain reasons and are done before a court hearing. This study aims to find out about the legal basis in the settlement process of the Sukoharjo Religious Court's decision regarding divorce cases due to the factor of infidelity and to determine the suitability of the Sukoharjo Religious Court's decision No.196 / PDT.G / 2018 / PA. Law No. 1, 1974. This research uses a juridical approach. This type of research uses normative legal research. The results showed the legal basis underlying the divorce case settlement process because of the affair of ruling No. 196 / Pdt.G / 2018 / PA.Skh has been legally stipulated in the rule of law, namely general legal regulations. Legally the verdict and legal considerations in it have been in accordance with the applicable laws and regulations and are not in conflict with the legal objectives specified in Law Number 1 of 1974 concerning Marriage.
