Abstract

In the life of indigenous peoples, land is understood as a hereditary unit inhabited, controlled and managed by indigenous peoples both as a buffer for sources of livelihood and as a marker of identity. It is this identity that can later become one of the sources in recognizing whether or not the position of customary land rights is recognized for customary law communities in relation to the agrarian legal system. This study aims to find out the institution of land tenure rights in customary law in Indonesia, knowing that the national agrarian legal system guarantees the position of customary land rights. The research method uses the Normative Approach method that is of type descriptive, primary legal material data sources and secondary legal materials, data collection techniques used through library studies, using qualitative data analysis. The results of the study show that indigenous peoples' unity with their traditional rights that are still alive are recognized by their existence. The customary rights of existence in the UUPA are already recognized, but the recognition is still followed by certain conditions.
