Abstract
The validity of the apartment purchase agreement explained in Article 1320 of the Civil Code says that for a contract to be valid, four conditions are required and the first condition is "Agreement from those who bind themselves (de toestemming)". Article 1338 in Paragraph (3) of the Civil Code is stated: "the agreement must be implemented in good faith. "Good faith means the inner state of the parties to make and execute contracts in an honest, open and trusting manner. Specifically, the arrangement of this Binding Sale and Purchase Agreement (PPJB) is regulated in Article 43 of Law Number 20 of 2011 concerning Flats which states that the process of buying and selling of sarusun before the construction is completed can be carried out through a Binding Sale and Purchase Agreement (PPJB) before a Notary Public . The problem of granting an apartment certificate in the contents of the agreement has a very high level of risk to consumers, because it has not yet received a certificate of ownership from an authorized official, namely PPAT. Business actors in carrying out their business apply economic principles, which get the maximum benefit with the minimum expenditure possible.
