Abstract
In the provisions of Article 1 Paragraph 2 and Article 1 Paragraph 3 the 1945 Constitution of the Republic of Indonesia states that the Indonesian State is a country of law and democracy. Which has the characteristics of a power distribution system into 3 branches namely executive, legislative and judiciary. One branch of power, namely the legislative power, that is, the DPR is given the right to immunity to carry out its duties and functions better. Regarding the issue of the immunity rights of members of the House of Representatives in the Indonesian system of order and what is the purpose of getting due to special treatment. The research method used is normative-juridical by using secondary data sources and analyzing the concept or theory in constitutional law and comparing with parliaments between countries. The results of discussions on regulating the immunity rights of legislative members are contained in Law No. 2 of 2018 concerning the MPR, DPR, DPD and DPRD as well as Law No. 17 of 2014 concerning the MPR, DPR, DPD, and DPRD. Regarding the rights of immunity possessed by members of the House of Representatives regulated in Law No. 2 of 2018 About MD3 there is special treatment to carry out its duties and functions as representatives of the people. The immunity rights of DPR members are limited to carrying out their duties and authority and have special treatment for the law enforcement process that is not completely immune.
