Abstract

in the Article 284 of the Criminal Code only recognizes adultery for perpetrators who are bound by marriage. As a result, if the people who make intercourse are not currently married, they are not categorized as adulterers. But it is different if the actors differ in their status positions. In the Article 284 of the Indonesian Criminal Code has other terms, namely participating in adultery for perpetrators who are free from marital ties but consciously and knowingly engage in a relationship like a husband and wife with an opponent who is bound by marriage. Therefore, it is necessary to know and clearly explain the differences in the position of the perpetrators in adultery
