Abstract

Indonesia is a Unitary State that upholds the value of democracy. This is stated in the 1945 Constitution section 1 subsection (2) which states "Sovereignty is in the hands of the People and is carried out based on the Constitution". This section serves as a basis toward the existence of a democratic contest in choosing both central and regional leader. Regional election itself is one of the biggest democratic contests in Indonesia, but of course this kind of election has gone through a long and winding road to arrive at the current system. This was started from the elections conducted by the DPRD then becoming direct elections and then now becoming simultaneous elections throughout Indonesia. The Pilkada regime has also changed from the Regional Government Regime, then now becoming the General Election Regime. In terms of resolving lawsuit toward the results of elections, there are also many ups and downs. At the very beginning it was resolved by the Supreme Court then by the Constitutional Court. But it still raises many pros and cons because the authority of Constitutional Court in this matter does not exist in our country's Constitution. Afterwards, a decision was made by giving time to form a special court which concerns on regional head elections lawsuit. But until now the court has not yet been formed. Improvements in various aspects, both system and technical, are needed in the implementation of the largest regional democracy contest in Indonesia, so that at the future Pilkada can become a good representation of democracy in Indonesia.
